Usage terms for the Yavland platform.

1. Acceptance

By creating an account or using Yavland, you agree to these Terms on behalf of yourself and the company you represent. If you don't agree, don't use the service.

2. The service

Yavland provides field-operations software (estimating, proposals, jobs, scheduling, time tracking, inventory, equipment, media, invoicing, messaging, reviews, AI-assisted tools, and related features). We may add, change, or remove features.

3. Accounts

You're responsible for your account, keeping credentials confidential, and the activity of users you invite. Notify us promptly of any unauthorized use.

4. Acceptable use

You may not misuse Yavland or help anyone else misuse it. Prohibited uses include:

• Using the service for unlawful, fraudulent, deceptive, harmful, or abusive activity.
• Circumventing security controls, probing for vulnerabilities except through authorized reporting, reverse engineering, scraping, or interfering with the service.
• Reselling, sublicensing, renting, or providing Yavland as a competing hosted service without our written permission.
• Uploading or sharing content, photos, logos, customer information, or material references you do not have the right to use.
• Using SMS, email, review, or messaging features to send unlawful, misleading, spam, or non-consented communications. Your company is responsible for recipient consent, including TCPA, anti-spam, and similar requirements.
• Interfering with, degrading, or attempting to access other tenants' accounts, data, networks, or systems.

5. Your data

You own the customer, company, job, media, and other data you put into Yavland. You grant us a limited license to host, process, transmit, display, back up, and otherwise use that data only as needed to operate, secure, support, and improve the service and as described in the Privacy Policy. You can export your company data at any time from the app.

6. Plans, billing & trials

Paid plans are billed per company on a flat recurring basis with unlimited users and one flat price: Field Ops is $149/month or $1,490/year; Full Platform is $299/month or $2,990/year. Each plan includes a 30-day free trial that requires a payment card and converts to the selected paid monthly or annual plan unless canceled before the trial ends. Optional one-time directed setup add-ons are available but never required: Field Ops setup is $998 and Full Platform setup is $4,500. Fees are billed in advance and are non-refundable except where required by law. You can cancel anytime in the app; cancellation stops future billing and takes effect at the end of the current period. Payments are processed by Stripe.

If a subscription is unpaid, access may be suspended. If the subscription remains unpaid, the account is held for at least 90 days, after which account data may be deleted under the Privacy Policy while minimal invoice and payment records are retained as legally required.

7. Third-party services

Features that connect to QuickBooks, Stripe, Twilio, or AI providers are subject to those providers' terms; we're not responsible for third-party services.

8. Availability & disclaimers

We use commercially reasonable efforts to keep Yavland reliable, but standard plans do not include an uptime service-level agreement. The service is provided "as is" and "as available," without warranties of any kind to the fullest extent permitted by law.

AI renders, AI suggestions, invoice extraction, estimates, analytics, and similar outputs are decision-support and concept tools only. They are provided "as is," are not guarantees, and may be incomplete or inaccurate. Verify measurements, costs, quantities, legal requirements, and customer-facing commitments before relying on them.

9. Limitation of liability

To the fullest extent permitted by law, Roberts Fixit LLC is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or substitute services. Our total liability for all claims relating to Yavland is limited to the amounts you paid to us for the service in the 12 months before the claim.

10. Indemnification

You will defend, indemnify, and hold Roberts Fixit LLC harmless from claims, damages, losses, liabilities, costs, and expenses arising from your content, your use or misuse of the service, your violation of these Terms, your violation of law, or your failure to obtain required consent from message recipients.

11. Communications

By providing contact information, you consent to receive service, transactional, security, billing, and account communications from us. Marketing communications are optional and may be opted out of at any time; service and account messages may still be sent where needed to operate the service.

12. Termination

Either party may terminate these Terms. You may stop using Yavland and cancel anytime. We may suspend or terminate access for breach, misuse, security risk, or non-payment. On termination, you can export your data for a reasonable window before deletion, subject to the non-payment hold and deletion policy in the Privacy Policy and our legal obligation to retain minimal financial records.

13. Dispute resolution & governing law

These Terms are governed by the laws of the State of Arizona, USA, without regard to conflict-of-laws rules. The parties will first try to resolve disputes informally and in good faith by contacting support@yavland.com.

14. Changes

We may update these Terms; material changes will be notified in the app or by email, and continued use means acceptance.
